If that's the case, then yeah, but using a EULA is a very poor way of communicating the author's wishes. Who does that? EULAs are for conveying a corporation's or organization's wishes, not really the programmers'. In many cases, the authors don't even have any legal say in the manner and what they want is irrelevant (believe me, I know). Since no individual would every write crap like some of these modern-day EULAs, it's assumed it has nothing to do with the actual author. Of course, the author(s) has chosen that agreement with the company/organization, but that doesn't mean that they would use a similar EULA/license if they were free to choose what they wanted. A simple read-me that's obviously the author(s) own words works way better than a generic EULA, because that's when respect on a personal level comes in.
Case in point, remember when Sysinternals didn't have all those EULAs? Then Microsoft bought them. That's why there's EULAs. Not because the authors' randomly decided it would be a good idea include compulsory, registry-modifying, obese EULAs that only a faceless multi-billion dollar corporation could love. Playing the human card doesn't work so well. I don't know who the authors are, but if talking to one, maybe he/she would like to state what they are trying accomplish with the EULA? Maybe there really is some reason for it (other than because the boss said so), but I truly doubt that. |

The IA Regmon came along and died before Sysinternals was acquired by Microsoft. So any EULA / licensing that may apply in that case, would seem to be the one that was "active" at that time (2002? 2005?). And I'm pretty certain that license agreement would not have permitted distribution in the discussed manner (IIRC, one was to download the utility from Sysinternals, for each system one wished to use the utility on). <offtopic> Off topic, but... Three years later and still having EULA discussions... ![]() Perhaps author wasn't the correct term, OK. Still, there has always been some kind of license agreement to use the tools, even in the pre-Microsoft days. Bryce's comment here seems somewhat related to the discussion, but not necessarily at the level you are getting at. </offtopic>
